The Monarch-Chesterfield levee in Chesterfield Valley is located in westernmost St. Louis County, Missouri, within the boundaries of the City of Chesterfield (Figure 1). The nearest major city is St. Louis, Missouri, located 15 miles to the east. The study area is bounded on the north by the Missouri River, on the west by the St. Louis County line, on the south by St. Louis Southwestern Railroad, and on the east by Bonhomme Creek. The levee system, which is located along the east/south bank of the Missouri River between river miles 38.5 and 46.0. There are approximately 7,500 acres in the Chesterfield Valley, with approximately 4,700 acres protected by the 11.5-mile levee.

GET COPY OF SUBDIVISION INDENTURES

If you are part of a subdivision, then you have a Home Owner Association ("HOA") with Trustees. They are empowered to assess subdivison fees and special assessments as part of the Indentures that were filed with the county before your house was built.

INCOMING RELOCATIONS:

Very important step in Executive Relocations, where the relocation package usually requires that you purchase a home on a street that is maintained and repaired by the city, county, state --- or a private road that is covered by a recorded Road Maintenance Agreement.

Great idea to get a copy of these indentures, ask the subdivision trustees for a copy.  Or you can get a copy emailed to you or your lender or relocation service provider for a cost of approximately $10.00

Private Road Maintenance Agreement Law & Legal Definition

A private road maintenance agreement is often entered into for roads that are privately maintained, rather than maintained by a public body. For example, most state laws require the cost of maintenance for privately maintained roads to be shared equitably by the landowners benefiting from those roads. Lacking a formal agreement between landowners, the law usually requires an equal share contribution from each landowner. This is enforced through civil action, in other words, by neighbor suing neighbor. Private road maintenance agreements vary by jurisdiction, so local law should be consulted for specific requirements.

Neighbors in a private road maintenance agreement are responsible for paying the freight and organizing the work. Typical agreements require monthly, quarterly, or annual payments to the treasurer of the private road maintenance or homeowners' association. Maintenance occurs when a majority of participating owners decide it's necessary or according to a pre-approved schedule. Another method for road maintenance involves a combination of annual homeowner payments and county or city maintenance.

New Word on Private Road Maintenance Agreement



As per Fannie Mae Announcement 08-01 January 31, 2008

"If the property is located on a community-owned or privately-owned and maintained street, Fannie Mae will now require one of the following:

1. An adequate, legally enforceable agreement or covenant for maintenance of the street. The agreement or covenant should include the following provisions and be recorded in the land records of the appropriate jurisdiction:
o Responsibility for payment of repairs, including each party’s representative share;
o Default remedies in the event a party to the agreement or covenant fails to comply with his or her obligations; and
o The effective term of the agreement or covenant, which in most cases should be perpetual and binding on any future owners.
If the property is located within a state that has statutory provisions that define the responsibilities of property owners for the maintenance and repair of a private street, no separate agreement or covenant is required.
2. If the property is not located in a state that imposes statutory requirements for maintenance, and either there is no agreement or covenant for maintenance of the street, or an agreement or covenant exists but does not meet the requirements listed above, the lender must indemnify Fannie Mae for any losses or expenses it may incur due to the physical condition of the street or in order to establish and/or retain access thereto .
The property must continue to meet all other requirements, including any requirements related to adequate vehicular access, as outlined in the Selling Guide."

Sample of Private Road Agreement:

WHEREAS, it is desired that the ROAD be maintained in a safe and usable condition by the LOT OWNERS; and, WHEREAS, it is desired hereto to establish a method for the maintenance and repair of the ROAD and for the apportionment of the expense of such maintenance and repair among existing and future LOT OWNERS; and WHEREAS, it is the intention that this Agreement constitute a covenant running with the land, binding upon each successive LOT OWNER of all or any portion of the PROPERTY until such time as the ROAD shall be dedicated to, and accepted for use as a public road by a government entity, NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:

1. The PROPERTY is benefited by this Agreement, and present and successive LOT OWNERS of all or any portion of the PROPERTY are expressly bound hereby for the benefit of the land. 

2. The cost and expense of maintaining the ROAD shall be divided equally among the lots created in the subdivision and paid by the LOT OWNER or the heirs, assigns and successors in interest of each such owner.  However, notwithstanding anything else set forth in this agreement, after DEVELOPER has chip sealed the ROAD, for the first six (6) years of the Second Amended Grayhawk Estates Road Maintenance Agreement, DEVELOPER shall not be required to participate in ROAD maintenance costs, nor for any liability incurred as a result of such maintenance, for any Lots owned by DEVELOPER, and the pro rata share of said costs or liability shall be determined by first excluding any lots currently owned by DEVELOPER.  Should DEVELOPER own any lots at the end of this six (6) year period, DEVELOPER will thereafter be treated as any other LOT OWNER and will participate in maintenance of the ROAD. 

3.In the event any of the herein described lots are subdivided further, the LOT OWNERS, heirs, assigns and successors in interest of each such newly created lot shall be liable under this Agreement for their then pro rata share of expenses and such pro rata shares of expenses shall be computed to reflect such newly created lots.

 4. The repairs and maintenance to be performed under this Agreement shall be limited to the following, unless the consent for additional work is agreed to by a majority vote (sixty seven (67) percent) of the LOT OWNERS owning 100% of the number of lots, excluding lots owned by DEVELOPER as described in paragraph 2 above, and including subdivisions thereof as described in paragraph 3 above: reasonable and normal road improvement and maintenance work to adequately maintain said ROAD and related drainage facilities to permit all weather access. Repairs and maintenance under this Agreement shall include, but is not limited to, filling of chuck holes, repairing cracks, repairing and resurfacing of roadbeds, repairing and maintaining drainage structures, utilities improvements, signs, markers, striping and lighting, if any, and other work reasonably necessary or proper to repair and preserve the easement improvements.  Individual Lot Owners are to keep the easements on their property up to and including the roadway drainage ditches, free of weeds and debris.

 5. Any repair required to correct damage to said ROAD that results from action taken by or contracted for by LOT OWNERS or their successors in interest shall be paid for by the party taking action or party contracting for work which caused the necessity for the repair. The repair shall be such as to restore the ROAD to the condition existing prior to said damage within sixty (60) days.

 6. It is agreed that DEVELOPER is initially the agent to contract and oversee and do all acts necessary to accomplish the repairs and maintenance required and/or authorized under this Agreement.  The DEVELOPER may relinquish this responsibility at any time, but once the DEVELOPER owns less than ten percent (10%) of the lots, or no later than January 1, 2009, whichever is earlier, the DEVELOPER will no longer be the agent and the LOT OWNERS must elect a new agent from among the other existing LOT OWNERS.   Repair and maintenance work on the ROAD shall be commenced when a majority of the LOT OWNERS agree in writing that such work is needed. The agent shall obtain three bids from licensed contractors and shall normally recommend accepting the lowest of said three bids.  A majority vote of the LOT OWNERS is required to accept a bid. The agent shall be paid for all costs incurred, including a reasonable compensation for the agent’s services, and such costs shall be added to and paid as a part of the repair and maintenance cost; provided, however, that compensation for the agent’s services shall in no event exceed an amount equivalent to 10% of the actual cost of repairs and maintenance performed.  The agent shall notify the parties of the funds required and each party shall within forty-five (45) days pay the agent, who shall maintain a trustee account and also maintain accurate accounting records which are to be available for inspection by any Lot Owner or authorized agent upon reasonable request. All such records shall be retained by the agent for a period of five years.  When adequate funds are available in the trustee account, the agent shall then initiate the work.

 8.Should any LOT OWNER fail to pay the pro rata share of costs and expenses as provided in this Agreement, then the agent or any LOT OWNER or OWNERS shall be entitled without further notice to institute legal action for the collection of funds advanced on behalf of such LOT OWNER, and shall be entitled to recover in such action in addition to the funds advanced, interest thereon at the current prime rate of interest, until paid, all costs and disbursements of such action, including such sum or sums as the Court may fix as and for a reasonable attorney’s fee’s.

 9.Any liability of the LOT OWNERS for personal injury to the agent hereunder, or to any worker employed to make repairs or provide maintenance under this Agreement, or to third persons, as well as any liability of the LOT OWNERS for damage to the property of agent, or any such worker, or of any third persons, as a result of or arising out of repairs and maintenance under this Agreement, shall be borne, as between the LOT OWNERS in the same percentages as they bear the costs and expenses of such repairs and maintenance. Each LOT OWNER shall be responsible for and maintain his own insurance, if any. By this Agreement, the parties do not intend to provide for the sharing of liability with respect to personal injury or property damage other than that attributable to the repairs and maintenance undertaken under this Agreement

 10. The foregoing covenants shall run with the land until such time as the ROAD shall be dedicated to, and accepted for use as a public road by a government entity, and shall be deemed to be for the benefit of the land of each of the LOT OWNERS and each and every person who shall at anytime own all or any portion of the property referred to herein.

 11. It is understood and agreed that the covenants herein contained shall be binding on the heirs, executors, administrators, successors, and assigns of each of the LOT OWNERS.

 12. The terms of this Agreement may be amended only by the DEVELOPER within the first ten (10) years of its recorded date or when DEVELOPER no longer owns any of the lots, whichever comes first; and thereafter, only upon written approval of sixty seven Percent (67%) of the LOT OWNERS.

 13. This Agreement shall be governed by the laws of the State of Missouri. In the event that any of the provisions of this Agreement are held to be unenforceable or invalid by any court of competent jurisdiction, the validity, and enforceability of the remaining provisions shall not be affected thereby.

The image of this statue of the king on a horse was widely used as a graphical symbol of the City of St. Louis. 6.        The employee knows of no hidden or latent defects for which he/she might later be held responsible.


Ineligible Properties:

Certain properties are not eligible for home sale assistance under the Plan. They are:
1.        Properties housing more than two (2) families.

2.        Cooperative apartments.

3.        Residences which require an association's approval of purchaser.

4.        Any residence which is involved in current and/or pending litigation.

5.        Property with material defects (i.e., composite-type siding, etc.).

6.        Homes with Synthetic Stucco

7.        Income-producing properties.

8.        Homes with hazardous substances (i.e., toxic and/or pathogenic mold, radon, asbestos, etc.).

9.        Mobile homes (the company will move mobile homes to the new location in lieu of purchase or will reimburse closing costs under the Plan).  NOTE: Lots are covered only if mobile home and lot are sold together.

10.      Properties not conforming to local regulations and/or which do not qualify for a certificate of occupancy.

11.      Seasonal Residences.

12.      Properties or parts of properties used or acquired for speculative purposes.

13.      Farms, ranches, or homes located, on properties in excess of five (5) acres.

14.      Undeveloped lots and/or homes under construction or renovation.

Use this Moving Checklist to help you stay on track.

Moving Tips - 8 Weeks Before

ı Create a "move file" to keep track of estimates, receipts and other important

information.

ı Check with the IRS for possible tax deductions – including moving expenses.

ı Budget for moving expenses and start collecting estimates - including a moving quote

from ABF U-Pack.

ı Read up on moving tips and topics at our Moving Resource Center.

ı Start researching your new community. The Internet is a great resource for finding

online community guides and newspapers.

ı Contact the Chamber of Commerce to request their new resident packet.

ı Draw out a floor plan of your new home and start deciding which function each room

will serve. Begin planning how to move into your new home.

ı Begin researching auto shipping companies.

Moving Tips - 7 Weeks Before

ı Start compiling medical and dental records - including prescriptions and shot records.

Ask your doctors if they can refer you to a care provider in your new city.

ı Arrange to have school records transferred to your children's new school district

and/or daycare.

ı Get copies of any legal and financial records you need.

ı Arrange for veterinarian records to be transferred.

ı Call your insurance agent to see what changes to expect in your policies for changing

states. Ask if moving is covered and arrange for insurance for your new home.

Moving Tips - 6 Weeks Before

ı Make a list of things that are valuable or difficult to replace. Plan on shipping these by

certified mail or carrying them with you.

ı Make a list of friends, relatives and businesses to notify of your move.

ı Work your way through each room taking inventory and deciding what to donate or

throw away. Start planning a yard sale or contact your local charities.

ı Subscribe to the newspaper in your new hometown to start learning about events and

the local culture.

ı Begin using things that can't be moved, such as frozen foods, bleach and aerosol

cleaners.

Moving Tips - 5 Weeks Before

ı Begin collecting boxes and other packing supplies. You can order a wide selection of

moving boxes from U-Pack to be delivered to your door.

ı Begin packing items you don't use often. Also start separating and disposing of the

items you've designated for a yard sale, donation or the junk yard. If you donate, be

sure to get a receipt for income tax purposes.

ı Start pinpointing a "move date". This will be the day you receive your ABF trailer or

ReloCube for loading. Try to take advantage of the lower rates offered Tuesdays

through Thursdays and during the first three weeks of the month.

ı Plan ahead for parking the ABF Trailer or ReloCube. If you’re moving in an ABF trailer,

keep in mind that you'll be receiving a 28 foot commercial trailer, which will require a

14 foot overhead clearance and in most cases will need to be left overnight. You

should contact your property manager or local authorities to ensure you will be

complying with any parking restrictions.

ı Plan for short-term or long-term storage at destination if needed.

Moving Tips - 4 Weeks Before

ı Reserve your ABF move online or by calling 1-800-240-7422. Reservations should be

made at least one business day prior to your move date. Please keep in mind that

reservations are based on availability. If you are loading into a trailer, ramps are

available at most locations. Purchase furniture pads, mattress protectors, dish

protectors, two wheelers and more through the U-Pack Moving Boxes and Supply

Store.

ı File a change of address with the Postal Service. If you are unsure of your new

address, ask the postal service to hold your mail at their office in your new city.

ı Schedule disconnection of all utility services at your old home, and connection of them

at your new one. Be sure to disconnect the day after you leave and connect the day

before you arrive. If you have "last month" deposits with services, such as the water

or gas company, request your refund.

ı Make travel arrangements for your pets. Don’t forget to include necessary medical and

immunization records.

ı Advertise and host your garage sale.

ı Call your newspaper courier and set a date to cancel your subscription.

Moving Tips - 3 Weeks Before

ı Make sure all library books have been returned and all dry cleaning or items out for

repair have been picked up. Also retrieve any items out on loan.

ı Decide if you will keep your plants or give them away. Remember plants cannot be

loaded into the trailer or ReloCube.

ı Dispose of flammables, corrosives and poisons.

ı Have your automobile(s) serviced.

ı Prepare auto registration to be transferred.

ı If you are moving into or out of an apartment, arrange to use the elevator on your

move day.

Moving Tips - 2 Weeks Before

ı Contact your bank and/or credit union to transfer or close accounts. Clear out safety

deposit boxes. Pick up traveler's checks or cash for "on the road" expenses.

ı Confirm travel arrangements for pets and family.

ı Confirm parking for your trailer/ReloCube, and obtain parking permits if needed.

ı Notify any creditors of your move.

ı Plan meals for the last week of the move to help empty the refrigerator and avoid

using appliances that will already be packed.

ı Assemble a folder of important information about the house for the new owner of your

home.

Moving Tips - 1 Week Before

ı Contact your local ABF terminal to confirm a time to receive your trailer/ReloCube one

or two business days before your move.

ı Your ABF bill of lading (BOL) and moving checklist will be e-mailed to you prior to your

move. Review your BOL and contact your moving coordinator with any questions or

concerns.

ı Print two-copies of your Bill of Lading (BOL) and place in your moving file.

ı Notify friends and family of your new address and phone number with a free Moving

Notice.

ı Finish packing and prepare an "essentials" box. Designate several moving boxes and

items as "last load" items. Pack your suitcases and valuables separately.

ı Drain all gas and oil from your mower and other motors. Gas grills, kerosene heaters,

etc. need to be emptied as well.

ı Drain water hoses and waterbed.

ı Empty, defrost and clean your refrigerator at least 24 hours before moving day.

Prepare all appliances for loading.

ı Fill any prescriptions or medications you will need for the next couple of weeks.

ı Make childcare arrangements for moving day.

Moving Out Checklist

ı Make plans to be present when ABF delivers your trailer or ReloCube. You will need to

show the driver where you want the trailer parked and sign for delivery.

ı Inspect your trailer or ReloCube for cleanliness and leaks before signing for delivery.

ı Measure the space you reserved in the trailer so you know where your boundary is. If

you find that you need more or less space, simply adjust your base rate by the "per

foot" charge on your BOL.

ı Be familiar with our packing and loading tips and personally supervise hired labor. You

are ultimately responsible for how your goods are packed and loaded.

ı Load your goods in a pre-designated order, saving "last load" items for the rear of

your shipment. This might include your vacuum cleaner or bed sheets.

ı Check every room, closet and cabinet one last time before deciding everything is

loaded.

ı Install the bulkhead once your goods are loaded.

ı Verify the destination address and your contact information is correct on your BOL.

ı Write the number of linear feet or number of ReloCubes you loaded into on two copies

of the BOL. This is very important, as an accurate BOL ensures an accurate rate.

ı Call the local ABF terminal when your shipment is ready to be picked up.

ı If moving on an ABF trailer, verify the footage with the driver and both you and the

driver sign two copies of the BOL – keep one copy for your file and give one copy to

the driver.

ı Call your local terminal to verify charges and get your “pro” or tracking number the

day after your shipment is picked up. You can use this number to track your shipment

around the clock either online or by calling 1-800-FOR-ABFS.

ı Take note of utility meter readings.

ı Leave a note with your new address in the house so that future residents can forward

any stray mail.

ı Keep a friend or family member informed of your plans and "whereabouts" in case of

an emergency or unforeseen event.

Moving In Checklist

ı You are likely to arrive at your new home ahead of your shipment. Take this time to

look things over and to ensure your utilities have been connected.

ı Check appliances and systems to ensure all are working properly, and arrange for

repairs if necessary.

ı Verify that your mail is being delivered to your new address and pick up any mail

being held.

ı Consider drawing out your new floor plan and decide where you want furniture and

appliances placed.

ı Track your shipment and work with the local terminal to schedule delivery. Plan ahead

for parking.

ı Plan to be present when ABF delivers your shipment. Show the driver where you want

the equipment parked and sign for delivery. If you are unable to do this, work closely

with a friend or representative to accept your shipment.

ı Unless you are paying by credit card, have a cashier's check or money order ready for

the driver.

ı After your goods are unloaded, contact your local terminal to have your equipment

taken away. Be sure to remove all debris, and leave only the bulkhead and ramp when

moving in a trailer.

After the Move Checklist

ı Keep all receipts and documentation in your move file and store the file in a safe

place. Be sure to include your Bill of Lading and delivery receipt. You'll be glad to have

everything in one place at tax time.

ı Get a new driver's license and new tags for your automobile.

ı Register to vote.

ı Contact the local paper for a new subscription.
