What Level of Service can I Expect?
Our "Exclusive-Exclusive"™ agreement* with our Engaged Buyer Clients, available on properties with a contract price in excess of $275,000.00, where we commit as a company, to the most reasonable extent possible:
To represent only one buyer at a time for a certain zip code, in a certain price range, for an agreed time-certain, and for certain property desriptions & house desired criteria.

We make every attempt to represent only ONE BUYER AT A TIME IN A CERTAIN AREA AND IN A CERTAIN PRICE RANGE.
PRINCIPLE: MetroStar® goes to great lengths to avoid representing multiple Buyers that are looking at certain areas or zip code(s) in specific price ranges.
We represent and accordingly select one-at-a-time Exclusive Buyers of homes above $200,000 in $50,000 ranges; above $300,000 in $75,000 ranges; and above $500,000 in $100,000 ranges and finally $800,000 and higher in two absolute exclusive zip codes.
We turn down more business than we engage, since January of 2008, we have averaged over 74 Buyers per month that have expressed an interest in our representing their home purchase; we are running at a rate of selecting about 7 to 10 new exclusive clients per month.

We make every attempt to represent only ONE BUYER AT A TIME IN A CERTAIN AREA AND IN A CERTAIN PRICE RANGE.
We have never had two buyers going for the same house -- yet. Could it happen someday, yes -- if our Engaged Buyer#1 for Ballwin 63011 for a 4 bedroom between $175,000 - $225,000 suddenly decides to drive around Fenton and sees a 3 Bedroom home for sale at 321 Apple Street for $245,000 and calls us; then we would say to Buyer#1 that we already have an Engaged Buyer#2 for the Fenton 63026 area for 3 bedroom homes between $200,000 - $250,000, so Buyer#2 would have to waive interest in buying 321 Apple Street before we could represent Buyer#1 in offering a contract on that specific house.
This is Fair to both Buyers; and an extra step by MetroStar to attempt to avoid having two of our Buyers offering a contract on the same house.
We try very hard to avoid cross-representing two buyers that want the same house, in the same area, in the same price range; at the same time.
OBSERVATION: The Home Buyers that MetroStar® represents are presented to Sellers; to be “The Market”.
There are Very Few (less than 5%) Buyers above the $300,000 purchase mark in the Saint Louis area.
90% of all buyers would not qualify under the increased loan underwriting qualifications today, for loans above $250,000.
Extras are Negotiated for our Buyer’s benefit: Tremendous price discounts & Sellers paid Buyer’s closing costs.

"Does a buyer agent breach his obligation to a buyer under Missouri State Law when a buyer agent simultaneously represents more than one buyer competing for the same property?"
This Has Not Been Determined, yet. Would be a case of First-Impression.
In a divided opinion, the state Montana Supreme Court agreed with the plaintiff. Its answer was based primarily on the finding that Montana law imposes on a buyer's agent the obligation to "act solely in the best interests of the buyer," and that such an obligation was inevitably breached "when a buyer agent simultaneously represents more than one buyer competing for the same property … ."
Agency law is not uniform from state to state, and it is certainly possible that a different conclusion might be reached in some other states. The whole question is problematic, because it is quite likely that most state agency legislation and court decisions never anticipated this kind of situation.
Indeed, the Montana opinion did not characterize this situation as dual agency. That is because Montana law specifically defines dual agency as "a broker or salesperson who, pursuant to a written listing agreement or buyer broker agreement … acts as the agent of both the buyer and seller … ." So, under Montana law, this was not dual agency, inasmuch as the seller was not represented by the buyer's agent.
