Chapter 339 Real Estate Agents, Brokers, Appraisers and Escrow Agents Section 339.190 August 28, 2008
“Real estate licensee, immunity from liability, when.
339.190. 1. A real estate licensee shall be immune from liability for statements made by engineers, land surveyors, geologists, environmental hazard experts, wood-destroying inspection and control experts, termite inspectors, mortgage brokers, home inspectors, or other home inspection experts unless:
(1) The statement was made by a person employed by the licensee or the broker with whom the licensee is associated;
(2) The person making the statement was selected by and engaged by the licensee; or
(3) The licensee knew prior to closing that the statement was false or the licensee acted in reckless disregard as to whether the statement was true or false.
2. A real estate licensee shall not be the subject of any action and no action shall be instituted against a real estate licensee for any information contained in a seller's disclosure for residential, commercial, industrial, farm, or vacant real estate furnished to a buyer, unless the real estate licensee is a signatory to such or the licensee knew prior to closing that the statement was false or the licensee acted in reckless disregard as to whether the statement was true or false.
3. A real estate licensee acting as a courier of documents referenced in this section shall not be considered to be making the statements contained in such documents.”
That’s the question that we need to be asking potential buyers who are “on the fence” regarding a home purchase decision.
Waiting for lower mortgage rates?They’re already lower than they have been in recorded industry history!
Waiting for home prices to go down further?There are tremendous “bargains” out there right now.But only the buyers who make a move will benefit.
Will rates go down a half point further?Not likely, but what if they do? On a $100,000 loan, the difference between 4.5 percent and 5 percent amounts to just $30 per month—or $360 per year.Considering the fact that interest payments are tax deductible and rent is not, delaying just six months could take years to make up the difference even if the rates did go down further.
Will prices slide even further?Doubtful, as they’ve pretty well stabilized in many markets. And, unless you have a financial crystal ball, you’ll never know where the “bottom” really is until you see the rates or prices beginning to creep upwards.And by then it’s too late:you’ve missed the bottom!
There’s so many reasons for buyers who are ready and able to purchaseright now.We just have to make those reasons known!
In the previous “boom” years, with rapidly escalating home prices, people jumped to get on the buying bandwagon without much need for facts and figures.In today’s “after-shock” market, we need to be armed with the real facts and figures—not the doom and gloom that’s hyped by the media.And, strangely enough, the real facts and figures make a very strong case for buying now.
